불법조업 어선의 폭력적 활동에 대한 담론 : 안개 속의 괴물 – 한국의 사례를 중심으로
현재 한국은 지역적으로 불법조업 어선의 침범을 받고 있는 해양 지역 중 하나이다. 특히 ‘황해’로 불리는 한반도 서해는 동북아시아와 동남아시아의 다른 국가들과 같이 불법 어선들의 꿈의 목적지 중 하나이기도 하다. 이러한 상황이 ‘해양 안전’에 가장 위협이 되는 상황이라 볼 수 있다. 그 결과, 불법조업 선박들은 ‘항행의 자유’라는 안개 속에 숨어있는 ‘괴물’과 같은 존재가 되어 순찰과 단속의 의무가 있는 해양 경찰들을 괴롭혔다. 이 글에서는 해상에서의 약탈행위에 대한 인식과 이에 대한 법적, 관습적 규제에 대해 설명하고자 한다. 또한 신원 미상의 선박과의 싸움, 무력 사용, 인명 피해 등 심각한 문제들과 함께 해양 환경에 미치는 영향에 대해서도 논의할 것이다.
동북아시아는 역내 많은 국가들이 ‘해상 약탈’로 인해 피해 당한 경험이 있는 대륙으로, 특히 배타적 경제수역(EEZ)을 중심으로 불법조업이 여전히 활개를 치고 있다. 대한민국은 지리적, 제도적으로 완벽한 장벽을 가진 천혜의 자원을 보유한 나라로, 21세기 바다를 평화로운 곳으로 만드는데 작은 도움이 되고자 이 글을 통해 불법어선 문제에 대한 나의 견해를 밝히고자 한다. 이러한 상황을 설명하기 위해 한국을 선택한 이유는 역내 학자, 실무자, 전문가들이 모여 해양의 공익을 넘어 법치, 정의와 형평성을 증진하기 위한 의미 있는 대화에 참여해온 오랜 유산이 있기 때문이다.
이 문제에 대한 해양 법치주의는 글로벌 해양 번영, 안보 시스템 강화, 인권 보호의 기초 요소로 널리 인정받는 현대 세계 구축의 초석으로 자리 잡고 있다. 해양 효용성에 대한 중요성이 더욱 부각됨에 따라 동북아시아에서는 해상에서의 안전을 보호하기 위해 기존의 패러다임에서 벗어나 법치에 대한 독특한 해석을 제시한다. 이 해석은 해양 공동체의 조화, 집단 이익의 우선순위, ‘해양 안보’의 가치 보존에 중점을 두고 있다.
최근 5년간(2019~2024년) 한반도 서해를 침범한 안개 속 괴물로 불리는 중국 어선들의 불법조업은 현재진행형이라고 할 수 있다. 과거 많은 국가들이 자국 어업으로 활동을 시작했던 고대로 거슬러 올라가면, 과거에는 각국의 수산자원이 충분했기 때문에 한국 해역에서는 불법 어업 활동이 그리 많지 않았다. 그 결과 한 국가의 불법 어선이 다른 국가의 해역을 침범하는 심각한 사건은 발생하지 않았다.
산업화 시대부터 오늘날까지 동북아에서 식량, 특히 해산물에 대한 수요가 크게 증가했다. 반면에 일부 국가는 어업 활동에 필요한 첨단 기술의 부족, 어류가 해역으로 이동하지 못하는 바다의 부적절한 지리적 특성 또는 해역에서의 적절한 어업 활동에 대한 관리능력 부족 등의 이유로 국가에 충분한 공급을 제공하지 못한다.
일부 국가에서는 해양에서 생산되는 식료품에 대한 민간인의 수요를 충족시키지 못하자 합법적이든 불법적이든 다른 국가의 해역으로 해양 자원을 착취하는 행태가 시작되었다. “황금어장으로 불리는 황해는 꽃게, 청어, 소하치 등의 해양 자원을 보존하기 위해 황해 생태 지역으로 지정되어 보호되고 있는 지역이다. 안타깝게도 황해에서 회유하는 어종들은 외국 불법 어선들이 노리는 주요 표적이다. 그 결과 해양 생태 환경을 파괴할 뿐만 아니라 주로 인명 및 장비까지 피해를 미치는 어업 활동이 중국 불법 어선에 의해 계속되고 있다.
중국 불법조업 선단이 사용하는 일반적인 수법은 모선과 450마력 엔진을 장착한 소형 동력선 3~4척이 한 무리를 이루어 해상경계선을 침범하는 것이다. 한국 해경의 위험해역 순찰 정책 수립에 큰 영향을 미치는 전 세계 통계를 보면 중국어선들은 해경의 단속을 피하기 위해 어떠한 폭력도 서슴지 않고 있다는 것을 알 수 있다. 일반적으로 중국 불법조업 어선들은 선박자동식별장치(AIS)를 이용해 서해 해역에 불법으로 진입한 후 해양자원과 어종을 탐색하며 조업한다. 나포되지 않은 채 막대한 어획량을 노리는 중국 어선들은 단속을 당하면 고도로 조직화되고 정교한 계획으로 북상하여 해경의 단속을 피하기 위해 강력하게 대응한다.
2011년 3월 4일 불법조업 어선 선원들이 사용한 흉기인 단검과 망치로 단속반 경찰관이 중상을 입는 등 서해에서 발생한 사건사고를 보면 다음과 같다. 2011년 12월 12일 단속반 경찰관이 중국 어민에 의해 피살되었고, 2016년 10월 8일 단속반 단속선박이 중국 어선에 의해 침몰되었으며, 2012년 4월 20일 불법조업 중국 어선은 단속을 피하기 위해 ‘고의로 갈치배를 들이받고 지그재그 기동’을 하였다. 이렇듯 단속 회피를 위한 폭력 사용과 이로 인한 단속 경찰관 부상 및 기물 파손이 잇따르고 있다.
한국과 중국은 배타적 경제수역에 대한 협정을 체결하지 않고 ‘어업협정’을 체결했다. 따라서 외국 어선들의 불법조업으로부터 한국의 어장을 지키기 위해 ‘북방한계선’ 수역의 보호는 반드시 필요하다. 당시 한반도 수역의 어족자원을 지키기 위해 해경의 순찰과 예방활동을 하는 한국 해경은 불법조업선단과의 대치과정에서 선박 파손, 장비 손상, 인명피해 등 많은 위험을 않고 있었다.
그렇다면 이러한 불법조업 행위로 인한 주요한 영향은 무엇이며, 최근 발생한 사건의 이해당사자들은 무엇을 인정할까? 한반도에서 중국의 불법조업에 대응하기 위한 적절한 방법은 무엇일까? 평화적 수단, 외교적 수단 또는 해상에서의 무력 사용 중 20세기의 법적, 정책적 메커니즘으로서 “장기적으로 권장되는 해결책”은 무엇일까?
‘해양 안보’ 측면에서 한국은 불법 어획활동을 예방하고 보호하는 메커니즘에 적용되는 법체계의 원천을 옹호하고 있으며, 이는 효과적일 뿐만 아니라 불법 어획활동에 대한 한국 고유의 문화적 특성과도 잘 맞는다. 법치주의에 있어 한국은 국제적으로는 해양법을, 국내적으로는 관련 국내 규제를 제공하는 풍부한 관점의 혼합을 효과적으로 수용함으로써 포용적이고 응집력 있는 법적 지형을 향한 길을 개척할 기회를 갖게 되었다. 이러한 해양 환경은 동북아시아 전역의 다양한 공동체의 가치와 열망을 반영하고 존중하여 법치가 해양을 지배할 뿐만 아니라 통합과 상호 존중의 정신에 활력을 불어넣는 미래로 나아가는 길을 열어줄 것이다.
불법 어업 및 이와 관련된 해적 행위, 특히 배타적 경제수역에서 발생한 것과 같은 상황은 ‘해양의 헌법’이라 불리는 획기적인 협약인 유엔해양법협약(UNCLOS)의 일반 원칙에 항상 해당한다. ‘불법 어업’과 관련하여 이러한 법규는 ‘최적 효용성’ 원칙을 예외로 규정하고 있다. 특히 어업과 관련이 있는 것은 배타적 경제수역에 관한 제5부(55~75조)로, 유엔해양법협약은 연안국이 배타적 경제수역 내 수산자원의 탐사 및 이용, 보존 및 관리를 목적으로 하는 연안국의 주권적 권리를 인정하고, 연안국이 배타적 경제수역 내 수산자원의 최적 이용을 촉진하기 위해 보존 및 관리 조치를 채택하도록 촉구하고 있다.
그러나 유엔해양법협약이 채택되고 연안국들이 자국 배타적 경제수역 내 어업에 대한 권리와 관할권을 주장하면서 한반도에서 발생하는 이러한 상황은 ‘항해 위험’으로 간주될 수 있다. 서해에서 자국의 해양 천연자원을 보호해야 하는 의무에 따라 해양경찰은 생명과 선박의 안전을 걸고 해양 순찰과 보호 의무를 수행해야 한다. 이 문제를 놓고 고려해야 할 법적 기준으로는 무력 사용, 접근권, 방문권, 자기 방어, 그리고 전세계 해양과 바다에 적용되는 규칙 등이 있다.
이 협약은 황해 해역에 걸쳐 전세계 해양생물 및 비생물 자원을 동시에 보호하고 이용하기 위한 국제법적 근거를 제공한다. 하지만 이 협약은 해양자원 보호를 명시하는 출발점이자, 한국 해양 영역에 대한 침범과 같은 사안을 다루는 정치적 어업 결의안에 불과하다. 외국 어선의 불법조업이 여전히 큰 문제로 대두되는 이유는 불법조업 근절을 책임지고 있는 해양경찰과 관련 부서들이 의무와 무력 사용 비율 사이에서 균형을 잡는 것이 어렵고 복잡하기 때문이다.
한-중 어업협정은 선박의 등록 및 기록, 허가, 모니터링, 통제 및 감시(MCS) 등의 내용을 포함한 기국(旗國)의 의무를 명시하고 있다. 그러나 서해에서 발생하는 실시간 상황에 대한 ‘무력사용 대 정당방위’ 적용의 한계는 한반도 해양안보에 포함된 한국 경비함정의 해상 안전에도 큰 영향을 미친다. 무력 사용, 자위권, 방군권, 조사권, 추적권 등 어엽에 대한 행동강령은 해양경찰을 보호하고 지속가능한 결과를 얻기 위해 법적 권한 내용을 세부 지침 없이 광범위하게 작성되어 있다.
이러한 상황에서 선원의 주저와 망설임은 인명 손실과 선박의 손상으로 이어진다. 관련 국내 법규에서도 해양법의 핵심 원칙에 따라 기국 표시 및 통제에 관한 국제적 의무와 의무를 강화하고 감시하도록 규정하고 있지만, 불법 어선들은 대한민국 경비대와의 조우를 두려워하지 않는다. 그들은 국제법에 근거한 연안국 공무원의 책임 한계를 알고 있다.
불법어업 관리의 핵심 요소 중 하나는 선원 및 실무자의 결정이다. 불법, 비보고, 비규제 어업 행위로부터 선박의 안전과 직원의 생명을 보호하기 위해 취할 수 있는 조치의 범위는 선박 감시 시스템(VMS) 및 모니터링, 통제 및 감시(MCS) 활동이 포함되는데, 이는 황해에서 IUU 어업을 근절하는 가장 효과적인 조치가 되지는 않는다. 이 상황을 처리하는 경찰관 입장에서는 ‘무력사용과 정당방위’의 수위를 놓고 타협하고 고민해야 하는 요소들이 있기 때문이다. 따라서 정당방위 수위에 어긋나는 행동을 피하고자 하기 때문에 불법 어선의 무장 선원에게 어느 수준으로 대처할 것인지 결정하기 어렵다. 이러한 조치가 두 국가의 외교 및 정치 관계에 영향을 미칠 수 있기 때문에 무력사용 기준의 초과를 우려해야 한다.
이 문제를 제기하는 목적은 한반도에서 행해지는 불법조업과 관련된 국내외 법학 및 학계를 한데 모으기 위한 것이다. 역사적 배경부터 법제도까지 교류하고 아이디어를 공유하며 네트워크를 구축하여 불법조업으로 인한 손실과 피해를 보호해 나갈 수 있다. 본 글이 다양한 차원의 협력자들을 모으는 데 널리 활용되기를 바란다. 이 글을 통해 학계와 실무자들이 황해의 불법조업 상황으로부터 해상 안전을 확보할 수 있는 가능성에 대해 함께 고민해보는 계기가 되기를 바란다.
정책 제언
인공지능과 수산업 관련 기술이 빠르게 발전하는 시대에 불법조업으로부터 황해를 지키기 위해 근무하는 경찰관의 해상 안전을 어떻게 확보할 것인가가 앞으로의 과제이다. 양국 간 정보 교류와 협력을 증진하여 기국이 IUU 어업 행위를 시도하는 불법 어선을 제때에 통제하여 자국 영토를 보호할 수 있는 위치에 있도록 해야 한다. 또한 지침에는 각국이 선박의 규정 준수를 장려하고 규정 미준수에 대한 책임을 질 수 있는 방법이 명시되어야 하며, 국민의 생명과 안전을 효율적으로 보호할 수 있도록 실무자의 무력사용 원칙을 명확히 하는 것에 협력을 강화한다는 권고사항이 포함되어야 한다.
보존 및 관리 조치의 형태로 주로 존재하는 메커니즘도 이론적으로는 적절해 보일 수 있지만, 실제 상황으로 전환하면 IUU 어업 근절을 주요 목표로하는 포럼 등의 활동이 충분히 효과적이지 않다. 담당 실무자에게 보다 분명하고 명확하게 권한을 부여하는 것이 좋다.
항만국조치협정(PSMA), 유엔해양법협약(UNCLOS), 수산자원협약, 책임 있는 수산업을 위한 행동강령, 국제원양산업협회(IPOA-IUU), 기국 이행 자발적 지침, 어획량 문서화 체계 자발적 지침과 같은 기구 및 제도들은 모두 이러한 상황에서 어떻게 행동해야 하는지를 명시적으로 제시하고 있으며, 국제 협력과 제도 이행의 근간이 되고 있다. IUU 선박 목록, 연안국 및 기국 조치, 책임, 지역 어획 문서화 및 어획 인증 제도, 정보 교환 메커니즘, 모니터링 및 집행 등 한반도 평화를 위한 주요 정책은 지속적으로 발전해왔다.
The Discourses of Violent Activities of Illegal Fishing Vessel : Monster in the Mist- Narrative Case of Korea

Introduction
At present, Korea is one of the oceanic areas being invaded by the Illegal Fishing Vessel regionally. Korea is also one of the dream destinations for Illegal Fishing Vessel especially the “Yellow Seas” as Korea Peninsular which is currently encounter the same situation with other country in North East Asia and South East Asia. I considered this situation as one of most risk and dangerous against “Maritime Safety”. As a result of that, under Illegal Fishing Situation which have interfered the officers who have a duty to patrol and combat against the Illegal Fishing Vessel become like the “Monster” hiding in the mist of “Freedom of Navigation”. This article would describe over the distinctive legal and customary regulations toward this activity over the perception of predation at sea. Besides, together with the expression of the serious problems such as the fighting back with the unidentified vessel, use of force and casualties of life also the effect to the marine environment will be discussed.
North East Asia, the champion continent of many countries in region have still been invaded by this “Plunder at Sea” according to the number of the incidents, Illegal Fishing Situations are still blossomed in this sea territory especially Exclusive Economic Zone (EEZ). Seeing that, Korean Sea Area is full of natural living resources with perfect geographic and disciplinary barrier, I hope to express my vision on the problem of Illegal Fishing Vessel in the early modern world through this article in order to be a small puzzle which contribute the ocean to be a better place toward the peaceful means amidst 21st century. The reason that Korea being chosen to illustrate this situation is because of the longstanding legacy by convening scholars, practitioners, and experts from the region to engage in meaningful dialogues that aim to advance the rule of law, as well as justice and equity within the region and beyond over the utilities of the ocean.
The rule of law of the sea over this issue stands as a cornerstone in the edifice of the modern world, widely acknowledged as a foundational element for global maritime prosperity, the enhancement of security systems, and the safeguarding of human rights. As North East Asia gains more prominence over the ocean utilities, it presents a distinctive interpretation of the rule of law, one that change away from main paradigms in order to protect the wellbeing of safety at sea. This interpretation places a heightened emphasis on harmony of Maritime Community, the prioritization of collective interests, and the preservation of values of “Maritime Security”.
The Yellow Sea Large Marine Ecosystem (YSLME)

Current situations of Chinese fishing fleets as known as the monster in the mist attacked over Yellow Sea of Korea Peninsular recently during these 5 years (2019-2024), in general, is still considered ongoing. When we look back into the ancient time, many nations started their fishing activities by local fisheries, in the past, there are not that much illegal fishing activities occurred in Korean Sea Area because of the sufficient living marine resources of each own state. As a result of that, there are no such a severe incident where the illegal fishing fleets of one state invading into the sea territory of the other state.
During the time of Industrialization until nowadays, the demand of food especially the seafood product in this region is significantly increased. On the other hands, some states fail to provide the nation with the sufficient supply from the ocean with some reason for instance the lack of high technologies for the fishery activity, an inappropriate geographical of their ocean where it does not allow the fish stock to migrate into their sea area or the incapable to manage the proper fishing activity in their sea territory.
When it turns out that some state is not able to reach the demand of their civilian in term of food products from the ocean, the idea of marine natural living resources exploitation into other state’s sea area both legally and illegally had started. “Yellow Sea” (as known as Golden Fishing Ground) is the area where fish stocks for instance Blue Crab, Pacific Herring, Sohachi being protected in order to preserve the marine species also the Yellow Sea Eco-region. Unfortunately, those species which migrate in Yellow Sea are the main targets that the foreign Illegal fishing fleets aim for. As a result of that fishery activity which not only destroys the marine ecological environment but also mainly affects human being and equipment damages by Chinese illegal fishing vessels have been continued.
Normally, the regular methodology that the Chinese Illegal Fishing fleets apply is the mothership and group of small power boats with 3-4 450 HP engine packing and invading through the maritime border line. From the global statistic which significantly effect in the policy planning of the Korean officer to patrol the risk area shows that Chinese Fleets do not hesitate to risk any kind of violence to avoid crackdown by the Korean Maritime officer. Generally, Chinese illegal fishing fleets illegally enter the maritime domain of Yellow Sea and gradually explore the fish stock and other seafood species by using their Automatic Identification System (AIS). Since the Chinese fishing vessel intentionally aim for the huge amount of fish stock without being caught, that is the reason why when the fleets are suspected, they would fight back seriously in order to be able to flee away up north with their highly organized, elaborately plan to evade crackdown by KCG.
There are some illustrations of the incidents occurred in Yellow Sea; On Mar 4 2011, crackdown team officers seriously injured by Dagger, Hammer, the weapons which the crew members of illegal fishing fleets had used. Dec 12 2011, officer was killed by Chinese fishermen, Oct 8 2016, the rib boat of crackdown team was sank by Chinese fishing fleet also On April 20 2022, ‘Intentionally Ramming Rib Boat’ and Zig-Zag Maneuvering to evade crackdown. Use of violence to evasion crackdown apparently cause the injured to the officers and object damages by Chinese illegal fishing vessels.
Since Korea and China did not contribute the agreement over the “Exclusive Economic Zone (EEZ.)” but the “Fishing Agreement” instead. As a result of that, the protection of the “North Rim Line” Area in order to preserve the fishing area of Korean Nation from the Illegal Fishing Activities by those foreigner fishing vessels is necessary. The patrolling and preventing by Korean Officers to keep the “Maritime Safety” of Fish stock as the marine natural resources over Korea Peninsular then bare lots of risk from being attacked, hurt and/or casualty dead included the damage of the vessel, weapon also the equipment which attached to the vessel during the confrontation of the Korean Officers and the Illegal Fishing Fleets.
Then what is the significant impact from those actions of illegal fishing and what will the stake holders in those incidents acknowledge from what happen recently? What is the proper way to fight back the Chinese Illegal Fishing Activities in Korean Peninsular? What are the “Long Term Solution Recommended” either by Peaceful Means, Diplomatic Means or Use of Force at Sea as the legal and policy mechanism in this 20th century’s time

Korea in terms of “Maritime Security” is championing the sources for legal systems apply over the mechanism to prevent and protect the maritime safety that are not only efficacious but also deeply resonant with their unique cultural narratives on Illegal Fishing Activities. By wholeheartedly embracing the rich tapestry of perspectives that Korea’s narratives on the rule of law offer the Law of the Sea internationally and related inbound regulations domestically, I have the opportunity to carve out pathways toward a legal landscape that is both inclusive and cohesive. Such an oceanic landscape promises to reflect and honor the values and aspirations of diverse communities throughout North East Asia, paving the way for a future where the rule of law not only governs but also galvanizes the spirit of unity and mutual respect over the ocean.
Illegal Fishing and related piracy like situation especially the one happened in EEZ (Exclusive Economic Zone) always fallen under the general principal of The United Nations Convention on the Law of the Sea (UNCLOS) which is a landmark instrument described as a “Constitution for the Oceans”. In terms of “Illegal Fishing”- these rules of law would describe the “Optimum Utility” principal as the exception of it. Of particular relevance to fisheries are their Part V (articles 55 to 75) on the Exclusive Economic Zone (EEZ), UNCLOS recognizes the sovereign rights of the coastal States for the purpose of exploring and exploiting, conserving and managing fishery resources in their EEZs, calling upon the coastal States to adopt conservation and management measures to promote the optimum utilization of fishery resources in their EEZs.
However, as UNCLOS was being adopted and as more coastal states claimed their right and jurisdiction over fisheries in their EEZ, this circumstances that occur in Korean Peninsular could be considered as “Navigation risk”. It is undeniable that according to the duty to protect its own marine natural resources in Yellow Sea, the responsible officer has to risk their life and the safety of vessel to perform their duty of patrolling and protecting the ocean. While we navigating through the cosmos of the law of the sea over this issue, the legal standards that need to be considered accordingly are Use of Force, Right of Approach, Right to Visit, Self Defense also Search rules governing all uses of the world’s oceans and seas and their resources.
It provides the international legal basis for the protection and use of living and non-living resources of the world’s oceans at the same time over the Yellow Sea Area. However, The Convention is the point of departure with respect to the conservation of living marine resources, for binding and voluntary international fisheries instruments such as those adopted by the Food and Agriculture Organization of the United Nations (FAO), as well as non-binding but politically significant fisheries resolutions, such as those invading into South Korean Maritime Zone. The reason that illegal fishing by foreign fleets is still the big problem to the officers and the departments who have responsibility over the eradication of illegal fishing activity is it is difficult and complicated to balance between the duty and the proportion of use of force.
The Fishing Agreement between China and Korea, also spells out the duties of flag States including those related to registration and records of vessels, authorizations, MCS and compliance and enforcement. However, the limitation of the application of “the use of force vs. self-defense” toward the real-time situation that happen in the Yellow Sea affect significantly to the safety at sea of the Korean officer also the Korean patrolling vessel which included in the Maritime Security over Korean Peninsula. A reasonable ground-breaking, unique and voluntary instrument that block the practitioner from apply the proportionated of those rules of law of the sea for instance use of force, self-defense, right to visit, right to investigate, and hot pursuit is code of conduct over fisheries was written broadly without the suggested detail as guide line to those officers on how they should legally apply those power for the long-term sustainable outcomes to protect themselves in this chaos.
The reluctance and hesitation of the officer’s performance result in the loss of life and the damage of the vessel during those situations. Even tough, the related domestic rules of law also the core principles from law of the sea provide guidance to strengthen and monitor compliance by Flag States with their international duties and obligations regarding the flagging and control of fishing vessels, still those illegal fishing fleets are not afraid of encountering the Korean Patrolling Team. They know the limit of relevant responsibilities of the officer from the Coastal States on the basis of elements contained in international law, including binding and non-binding international fisheries instruments.
Illegal Fisheries Management, are among the central components of the decision of the officer and the practitioner. The range of actions that countries can take to ensure that vessels and the life of the officer is secure under the IUU fishing conduct, including monitoring, control and surveillance (MCS) activities, such as vessel monitoring systems (VMS) and observers are the barrier to the most effective measure to get rid of IUU fishing in the Yellow Sea. Since there are the factors on the side where the officer who handle this situation has to compromise and concern over the level of “use of force and self-defense” . Hence, it is hard for them to decide how they are able to cope with the armed- crew member of those illegal fishing fleet because they don’t want to act against the level of self-defense. While they still have to concern of the over limit of use of force standard since those actions might affect the diplomatic and political relations of two states.
Conclusion
The purpose of the raising of this issue is to bring together law and scholarly from within and outside Korean that related to the illegal fishing being conducted in Korean Peninsula. From the historical background to the legal system to interact, share ideas and build networks which may facilitate dialogue and academic collaborations over the protection of lost and damage from illegal fishing activity. I hope that this academic article will be widely used to bring together collaborators in various dimension. This article encouraged to connect with academic fellow and practitioner to start thinking about potential of securing the safety at sea from the illegal fishing situation in Yellow Sea.
Recommendation
The future challenge remarks in this article are how to ensure the safety at sea of the officer on duty to protect the Yellow Sea from illegal fishing situation over the era when AI and technology related to fisheries develop so fast. The promotion of information exchange and cooperation among two countries so that flag states are in a position to prevent the illegal fishing vessels who attempting to conduct the action of IUU fishing meanwhile the coastal state can protect their own territory in time. The Guidelines should also include recommendations on how countries can encourage compliance and take action against non-compliance by vessels, as well as on how to enhance international cooperation to assist developing the measures to fulfil the interpretation of use of force principal for the practitioner like KCG who have responsibilities to make a sharp decision in order to efficiently protect the safety of their life.
Even the mechanisms exist primarily in the form of conservation and management measures are properly and theoretically set up, but when it turns to real situation, fora and task forces that include the elimination of IUU fishing as a primary objective are considered not effective enough. It is better to be more apparently and clearly grant the power and authorization to the officer who is on duty.
Instruments such as the PSMA, UNCLOS, the Fish Stocks Agreement, the Code of Conduct for Responsible Fisheries, IPOA-IUU, the Voluntary Guidelines for Flag State Performance and the Voluntary Guidelines for Catch Documentation Schemes, all explicitly identify and represent how to practice in this situation when discussing international cooperation and the implementation of these instruments. Some of the key initiatives to the peace in Korean Peninsular have continued to develop include IUU vessel lists, Coastal and Flag State measures, responsibilities, regional catch documentation and catch certification schemes, as well as information exchange mechanisms, monitoring and enforcement.
